Epic Hit with Lawsuit by Ex-Employee

Epic Systems, a Verona, Wisc.-based electronic health record (EHR) vendor, is being sued by a former employee for unpaid overtime, according to a report in the Wisconsin State Journal.

Epic Systems, a Verona, Wisc.-based electronic health record (EHR) vendor, is being sued by a former employee for unpaid overtime, according to a report in the Wisconsin State Journal.

The report, as well as supporting legal documents, indicates that former Epic quality assurance (QA) employee, Evan Nordgren and other salaried QA employees worked more than 40 hours per week and were not compensated in accordance to federal and state labor laws. According to the Wisconsin State Journal report, Nordgren’s suit alleges Epic did not pay him and another possible 1,000 past and present employees time-and-a-half.

In a statement provided to Wisconsin State Journal, an Epic spokesperson said the lawsuit is without merit. “We provide good, professional jobs to very talented people, and we value their contribution to improving health care. State and federal law make it clear that employees in computer-related jobs who primarily test software are appropriately classified as salaried professionals. That is precisely the role our quality assurance team performs,” Epic's spokesperson said.

In a briefing on the website of the attorneys representing Nordgren, lawyers say if anyone worked as an Epic QA at any time during the past three years they can join the class action by sending a consent form.

The settlement Nordgren and others are seeking is unclear and unstated at this time. According to the Wisconsin State Journal, William Parsons, one of Nordgren’s lawyers, said he believes it was a significant amount though.
